Privacy Policy and Data Protection

1.1 Introduction

 

We are committed to safeguarding the privacy of our website visitors and customers. This policy will explain how we will treat your personal information that complies with DPA (Data Protection Act 1998) and the GDPR (General Data Protection Regulation), effective from May 2018. It explains how we comply with the EU’s GDPR (General Data Protection Regulation) legislation and the DPA (Data Protection Act). 

 

 

1.2 In this policy, “we”, “us” and “our” refer to Victoria Greensmith Photography.

 

1.3 Our data controllers contact name is: Victoria Greensmith but and some data is delivered by the 3rd party site Wix to host the website.  Other third party sites who may hold data could include Google, Facebook, WeTransfer, Adobe and Instagram.

 

 

2. What information do we collect?

In order to create amazing work for our clients, we collect and use a very small amount of data for organisational purposes. This data will typically include your business contact information: Your name, job title, business email address, business telephone number. The Adobe sign form enables this and stores that information on their website server.

 

 

3. Why do we collect your data?

 

To confirm a booking we need to know who is responsible for the project within the organisation. As well as this we need to know and where to send our invoices. Without this information it would not be impossible for us to work on a project.

 

4. How do we collect your data?

 

There are a few different ways we could collect your data and these are as follows. We receive your information via email when you contact us. If you call us we will ask you during the conversation in order to assist you with your quotation/project. We will collect publicly available information from the organisations website. We will collect it via our social media sites. In the case of 3rd party the data is collected through a third party, the good use and correct application of privacy policy is the responsibility of said third party. In order to book we will invite you to fill out an Adobe sign form and discuss via Google Mail. Therefore information will be stored on Adobe and Google Mail.

 

5. How we use your personal data?

 

The personal data collected from the users will only be used in relation to the services offered by Victoria Greensmith Photography.

  • To help with the booking of the project and keep contact throughout the working relationship

  • To respond to any booking forms

  • To allow travel arrangements to be made for business related locations

  • To share content on social media

  • To send files to the customer via post or the internet

  • Contracts are mandatory when booking, and due to the legal nature, as kept in archive for present or future need

 

6. Security of your personal information

 

We will take reasonable technical and organisational precautions to prevent the loss, misuse or alteration of your personal information. However, data transmission over the internet is inherently insecure, and we cannot guarantee the security of data sent over the internet and 3rd party sites.

 

 

7. When will we share your data?

 

We will never share your personal data or sell your data with any 3rd party. We may publish several photos onto my social media or website for promotional purposes. We adopt a safe and responsible Social Media Policy. While we may have official profiles on social media platforms users are advised to verify the authenticity of such profiles before engaging with, or sharing information with such profiles. We will never ask for personal details on social media platforms. Users are advised to conduct themselves appropriately when engaging with us on social media.

 

8. Your Rights

 

You have the right to request your data at anytime. The user can at any time exercise their right to ask for their data to be deleted; this includes personal data and also archives of the products. They can also withdraw their consent to sharing of the products created for them on any social media, websites or portfolio website. Upon booking we do ask permission to upload photography to online portfolios prior to under taking the project, this is agreed to by the clients signature.

 

Anyone photographed by Victoria Greensmith Photography, may withdraw consent for a photograph in which they appear to be displayed. The process for this is to email Victoria Greensmith Photography at specifying the photo in question. With that request, Victoria Greensmith Photography will then remove the photo from online and printed display wherever it appears.

 

9. Policy amendments

 

We may update this privacy policy from time-to-time by posting a new version on our website. You should check this page to ensure you are happy with the changes we have made.

 

10. Third party websites

For wedding clients Victoria Greensmith Photography creates a client gallery for each client to whom photos are delivered as part of the services contracted. These galleries are hosted by Wix under a password protected online gallery. To visit the client gallery you will be required to enter a password. No entry of personal data is needed. Victoria Greensmith Photography will not be held responsible after you share the password with guests. Victoria Greensmith Photography does not allow the client to send the link to suppliers, publications or venues. A new contract with the third party needs to be drawn up for any change of use.

 

Users should note that they click on external links at their own risk and we cannot be held liable for any damages or implications caused by visiting any external links.

 

11. Clients and wedding guests captured in images

Under GDPR legislation, a photograph may in some instances constitute a form of personal data where they can be processed to allow “the unique identification or authentication of a natural person”. Victoria Greensmith Photography will never photograph an individual as a means of unique identification or authentication unless consensually contracted to do so. Guests at weddings appear in photos taken by Victoria Greensmith Photography as a part of the visual recording of the event in photos. Guests captured in portraits or in group photos do so as part of the event and their rights are protected by Victoria Greensmith Photography as detailed in this privacy policy. In terms of explicit GDPR compliance, Wedding clients and guests are photographed within the parameters of GDPR legislation on the basis of ‘legitimate interests’.

The taking of photographs of wedding guests when viewed as a form of processing personal data is necessary for the legitimate interests of Victoria Greensmith Photography as a photography business unless there is a good reason to protect a given individual's personal data which overrides those legitimate interests. Operating within the parameters of legitimate interests as laid out in GDPR legislation, the disproportionate effort involved in providing privacy policy information to all wedding guests at the event and the degree to which it would distract us from performing our job renders it infeasible to do. Wedding clients are therefore requested in their contract to direct their guests to read this privacy policy in advance of the event and to advise them to contact us in advance with any concerns around the processing of their personal data, namely being photographed.

 

12. Updating information

 

Please let us know if the personal information we hold about you needs to be corrected or updated.

 

13.Email marketing

 

Victoria Greensmith Photography does not engage in email marketing specific to our services. Your personal details will not be used for such marketing purposes nor will they be passed onto any third parties.
